Acceptance and Scope

By purchasing through Oro Dulce’s LLC website, social media, catalogs, or sales channels (collectively, the “Channels”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not make purchases or use our Channels.

These Terms apply to any purchase, reservation, pre-order, special order, or transaction made with Oro Dulce, whether online or via WhatsApp/DM.

 

Definitions

“Oro Dulce” refers to the commercial brand that sells 14-karat (14K) gold jewelry and its authorized representatives.

“Customer” means you, the person who purchases or attempts to purchase.

“Piece” or “Product” means any jewelry item offered by Oro Dulce.

“Order” means a purchase request confirmed by full or partial payment.

“Customized” includes engravings, special sizes, made-to-order combinations, made-to-measure pieces, or any modification requested by the Customer.

 

Eligibility and Purchases

To purchase, you represent that you are of legal age in your place of residence and that you have legal capacity to enter into a contract.

Oro Dulce may reject, cancel, or limit orders at its reasonable discretion to prevent fraud, address inventory errors, enforce these Terms, or respond to operational circumstances.

 

Products, Materials, and Certification

Our pieces are 14-karat (14K) gold according to the published specifications. Some pieces may include stones, zirconia, or other materials indicated in the description.

When applicable, we include a certificate or proof of authenticity. The certificate describes the piece and does not constitute an insurance policy.

Photos and videos are for reference: color, shine, size, and tone may vary due to lighting, screen settings, production batches, and visual perception.

 

Prices, Taxes, and Promotions

Prices are displayed in the currency indicated in the Channel (U.S. dollars). Taxes and fees (if applicable) are calculated and shown at checkout unless otherwise stated.

Promotions, discounts, and coupons: (a) may have validity periods and conditions; (b) are not cumulative unless expressly stated; and (c) may exclude customized pieces or limited editions.

Oro Dulce may correct pricing or description errors. If an order was paid at an incorrect price, we may (a) cancel and refund the payment, or (b) offer you the option to proceed by paying the difference, at our reasonable discretion.

 

Payments and Fraud Prevention

We accept the payment methods available at the time of purchase (cards, transfers, PayPal, Zelle, or others). Processing may be handled by third parties.

By paying, you authorize the applicable charge. If your payment is declined or reversed, the order will not be processed or may be stopped.

If there are reasonable indications of fraud or chargebacks, we may request identity/address verification, cancel the order, and restrict future purchases.

 

Safety, Health, and Responsible Use

Jewelry is not a toy. Keep out of reach of children and pets to prevent choking or accidents.

If you have allergies or sensitivity to metals, consult a professional before use. Oro Dulce does not provide medical advice.

 

Intellectual Property

All content (photos, videos, texts, catalogs, logo, designs, and graphic materials) is owned by Oro Dulce or used under the appropriate licenses.

Reproduction, distribution, or unauthorized use is prohibited without express written permission.

 

Customer Content (Reviews, Photos, and Testimonials)

If you send us photos, videos, reviews, or testimonials, you grant us a royalty-free, worldwide, non-exclusive license to use them for marketing, social media, and our website, always respecting your image.

If you wish to withdraw your consent for future use of that content, you may request it in writing and we will make reasonable adjustments.

 

Communications (Email, WhatsApp, and Messaging)

By purchasing, you agree to receive transactional communications (confirmations, order status, support).

Promotional communications: you may opt out by following the instructions in the message or by writing to us. On WhatsApp, you can request “STOP.”

Personal Data and Privacy

We use your data to process orders, shipping, billing, and support. We may share it with necessary service providers (payments, shipping, technology) or as required by law.

We implement reasonable security measures, but no system is 100% secure. By using our Channels, you accept this inherent risk.

 

Limitation of Liability

To the fullest extent permitted by law, Oro Dulce is not liable for indirect, incidental, special, or consequential damages (including lost profits) arising from the purchase or use of the pieces.

Oro Dulce’s LLC total liability for any claim is limited to the amount actually paid for the product that gave rise to the claim, excluding shipping costs.

 

Indemnification

You agree to indemnify and hold Oro Dulce harmless from third-party claims arising from (a) your improper use of the product, (b) violation of these Terms, or (c) content you share that infringes third-party rights.

Force Majeure

Oro Dulce is not responsible for failures or delays caused by events beyond its reasonable control (natural disasters, transportation disruptions, power outages, labor disputes, supplier failures, governmental acts, etc.).

Changes to These Terms

We may update these Terms at any time. The current version will be the one published on our Channels. Purchases are governed by the version applicable on the order date.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

Jurisdiction: the parties submit to the state and federal courts located in Monroe County, Florida, unless the law requires a different jurisdiction.

 

Severability and Entire Agreement

If any provision is deemed invalid, the remainder will remain in effect.

These Terms constitute the entire agreement between you and Oro Dulce regarding purchases and supersede prior agreements on the same subject.
